Terms of Service

Please read these terms carefully. They set out the rules for using NxaCare and the agreement between you and us.

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the NxaCare website, applications and services (the "Services"). By creating an account or using the Services, you agree to these Terms on behalf of yourself and any organisation you represent.

2. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account.

You must be at least 18 years old and authorised to act for your clinic to use the Services.

3. Acceptable use

You agree not to misuse the Services. In particular you will not:

  • Access data you are not authorised to access.
  • Reverse engineer, resell or attempt to disrupt the Services.
  • Upload unlawful, infringing or malicious content.
  • Use the Services in violation of applicable medical, privacy or data-protection laws.

4. Subscriptions and payment

Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice.

If payment fails, we may suspend access until outstanding amounts are paid.

5. Your data

You retain all rights to the data you and your clinic put into the Services. You grant us a limited licence to host and process that data solely to provide the Services.

You are responsible for ensuring you have the necessary consents to store patient data in NxaCare.

6. Intellectual property

The Services, including all software, design and content provided by NxaCare, remain our property. These Terms do not grant you any rights to our trademarks or branding.

7. Availability and support

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance and will give reasonable notice of planned downtime where possible.

8. Disclaimers

The Services are provided "as is". NxaCare is a software tool and does not provide medical advice. Clinical decisions remain the sole responsibility of qualified practitioners.

9. Limitation of liability

To the fullest extent permitted by law, NxaCare will not be liable for indirect, incidental or consequential damages. Our total liability for any claim is limited to the fees you paid in the 12 months preceding the claim.

10. Termination

You may cancel at any time. We may suspend or terminate access for breach of these Terms. On termination you may export your data for 30 days, after which it may be deleted.

11. Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
